Europcar Australia Rental Terms for travel between 01-May-2010 and 31-Dec-2011

1. Your Rental Contract
All rentals are subject to the terms and conditions of the rental agreement.

There are words and phrases used in the Rental Contract that have a particular meaning that You need to be familiar with.

Accident means an unintended, unforeseen, happening, incident or mishap, which is neither expected nor designed.

Administration Fee means this covers the cost incurred by Europcar for the processing of the Rental Agreement documentation and charges.

Authorised Driver means any driver approved and recorded by Us, either on the Rental Agreement or by prior written agreement.

Commercial Vehicle means a Vehicle that is a van, utility, truck or bus that is constructed and used for the carriage of goods or property or for the transport of more than 8 persons including the driver.

Damage means any loss or damage to, or theft of, the Vehicle, towing and salvage fees and any loss or damage to third party property.

Damage Liability Fee (DLF) means the amount payable to Us in the event of Damage arising from an Accident. The amount payable is shown in the Rental Agreement and is subject to GST.

Debit Card means Debit MasterCard or Visa Debit Card.

Europcar means “the owner” on the Rental Agreement or where applicable an independent Europcar licensee.

Final Inspection means the inspection carried out after We have taken possession of, and fully inspected and cleaned the Vehicle at the end of the Rental Period.

Gazetted Road means a sealed or unsealed road regularly maintained by a local, state or government body or council.

Loss of Use means the fee calculated at 75% of the standard daily rate if We cannot rent out the Vehicle because it needs repair and We are waiting for the repairs to be completed or it is a write-off or has been stolen and we are waiting for it to be replaced.

Off Road means any area that is not a gazetted road nor a sealed road nor an Unsealed Road and includes but is not limited to fire trails, tracks, river and tidal crossings, creek beds, beaches, streams, dams, rivers, flood waters, sand, deserts, rocks, fields and paddocks.

Other Cover Products means Super Peace of Mind (SPOM), Peace of Mind (POM), Loss Damage Waiver (LDW) and Windscreen Headlight and Tyre Puncture (WWI).

Overhead Damage means any damage at or above the level of the top of the front windscreen of the Vehicle and to any part of the pantech or box section of a Commercial Vehicle.

Premium Location Surcharge (PLS) means the extra amount payable to Us when a Vehicle is hired from a premium location. The amount is shown in the Rental Agreement and is adjusted if a DLF is payable.

Passenger Vehicle means any vehicle other than a four wheel drive that is designed to carry more than 3 people including the driver.

4WD (four wheel drive) means any vehicle whose class code contains F as the second letter. The vehicle class appears on the Rental Agreement.

Rental Charges means all rental and associated charges plus GST or other taxes and levies required by law, and credit card and vehicle registration recovery fees, all shown in the Rental Agreement.

Rental Station means the branch or rental location from which You hired the Vehicle.

Rental Period means the period shown in the Rental Agreement or as extended by Us.

Sealed Road being a road sealed with a hard material such as tar, bitumen or concrete.

Snow Cover means the additional cover that allows the Vehicle to be driven in areas above the Snow Line.

Snow Line means the gates leading to any of the national parks or snowfields in Australia between 1 June and 31 October, or any area where it is indicated or required that snow chains are to be fitted to the Vehicle.

Start of Rental means the date and time that the rental commences at the Rental Station shown in the Rental Agreement.

Substitute Vehicle Insurance means a policy of motor vehicle insurance held by You or an Authorised Driver which covers You or the Authorised Driver while You or they use the Vehicle as a substitute for the vehicle insured under that policy.

TOL relates to prepaid electronic tolls and, if You accept TOL on the Rental Agreement, You agree to pay the daily toll fee.

Unsealed Road means a road that is not sealed with a hard material such as tar, bitumen or concrete.

Unsealed Road Cover 4WD means the additional cover that allows some classes of Vehicle to be used on an Unsealed Road provided that the road is gazetted but it never allows the use of the Vehicle Off Road.

Unsealed Road Cover - ALWD means the additional cover that allows some classes of Vehicle to be used on an Unsealed Road provided that the road is gazetted and graded and maintained by a local, state, territory or government body, authority or council but it never allows the use of the Vehicle Off Road.

Vehicle means the vehicle described in the Rental Agreement and includes its parts, components, accessories, audio equipment and tools or any vehicle substituted by Us pursuant to the Rental Contract.

VRRF means Vehicle Registration Recovery Fee charged to partially recover the Vehicle registration costs.

We, Us, Our means Europcar or one of its, franchisees or affiliates as shown in the Rental Agreement.

You, Your means the person, firm, company or organisation renting the Vehicle or any Authorised Driver shown in the Rental Agreement.

2. Rental Period
2.1 Your rental of the Vehicle from Us is for the Rental Period and at the rate shown in the Rental Agreement.

2.2 The Vehicle must be returned to the Rental Station, on the date and by the time shown in the Rental Agreement.

2.3 We understand that circumstances change and that You may require the Vehicle for longer than the Rental Period. If so, You must notify Us at least 2 hours prior to the expiration of the Rental Period.

2.4 If We have agreed to an extension of the Rental Period and:
a. You are paying by cash, cheque or Debit Card, You must take the Vehicle to the nearest Europcar rental station and pay Your additional Rental Charges prior to the commencement of the extended Rental Period; and if,
b. Your extended Rental Period is longer than 30 days, You must take the Vehicle to Your nearest Europcar rental station on day 29 and every 30 days thereafter to pay Your additional Rental Charges for the extended Rental Period;
unless You have Our prior written agreement varying these conditions.

2.5 If You fail to notify Us at least 2 hours before the expiration of the Rental Period that You require an extension We may:
a. terminate the Rental Contract; and
b. recover the Vehicle by lawful means.

2.6 A ‘No Show’ fee may apply if You fail to notify Us of Your intended cancellation prior to the date and time of the commencement of Your reservation.

2.7 We reserve the right to substitute a suitable replacement vehicle at any time.

3. Costs, Charges & Payment
3.1 At the end of the Rental Period You must pay Us:
a. the Rental Charges;
b. all reasonable costs to return the Vehicle to the same condition it was in at the Start of Rental including but not limited to extra cleaning;
c. any amounts payable under clauses 4.6 and 4.7.

3.2 If there is Damage and You have not purchased SPOM You must pay the DLF to Us within 7 days of Our demand being made to You. If You have not paid the DLF within this period You are in breach of the Rental Contract. You then have no cover and are liable for each of the items and amounts payable under clause 4.6.

3.3 We accept all major credit cards. Payment by Debit Card, cash or company cheque is acceptable in limited circumstances and payment by any of these means requires a bond to be paid to Us at the Start of Rental. Personal and travellers’ cheques are never acceptable. You should check with the Rental Station that Your proposed means of payment is acceptable to Us before signing the Rental Contract.

3.4 At the Start of Rental there must be sufficient funds available on Your credit card, Europcar charge card or Debit Card to cover the Rental Charges and any relevant bond applicable.

3.5 When collecting the Vehicle the primary cardholder must be present.

3.6 The Vehicle is supplied with a full tank of fuel. If You do not take the “prepaid fuel” option and return the Vehicle without a full tank of fuel a refuelling charge will apply. You must also pay for any fuel used for the delivery and collection service.

3.7 You are liable for and must pay:
a. all tolls or levies;
b. speeding and other traffic fines, infringements and penalties;
c. government and other competent authority costs for parking, clamping, towing, release from compounds;
d. court fees or costs, arising out of the use of the Vehicle whether You were driving the Vehicle or not.

3.8 We may supply Your details to any government or other competent authority upon its request and a processing fee applies if We do. If we have paid any amount for which You are liable under clause 3.7 You will also be charged that amount together with the processing fee.

3.9 You acknowledge and authorise Us to charge any credit card, Europcar charge card or Debit Card nominated at the Start of Rental and shown in the Rental Agreement with all amounts due to Us under the Rental Contract, including the DLF and any amounts payable under clauses 4.6 or 4.7. These charges may be made at any time during or after the end of the Rental Period.

3.10 If You hired the Vehicle from a premium location a PLS will apply.

3.11 If currency conversion is required for payment of amounts due to Us under the Rental Contract, We will apply the commercial exchange rate valid at the time We credit or debit Your credit card, Europcar charge card or Debit Card.

4. Covers And Waivers
4.1 The Damage Liability Fee (DLF) shown in the Rental Agreement must be paid if there is Damage.

4.2 If Other Cover Products are purchased to reduce Your liability We will provide cover for Damage but unless You have purchased SPOM You must pay the reduced DLF shown in the Rental Agreement.

4.3 The DLF shown in the Rental Agreement is payable for each separate event and whether You are at fault or not. It is payable to Us within 7 days of Our demand being made to You.

4.4 Neither DLF nor Other Cover Products provide cover for personal belongings and each level of cover is subject to You not being in breach of the Rental Contract.

4.5 If the Vehicle is involved in an Accident and You have purchased:
a. SPOM, which is Our premium cover, Your DLF liability is nil;
b. POM, Your DLF is reduced to the amount shown in the Rental Agreement and it includes WWI;
c. LDW, Your DLF is reduced to the amount shown in the Rental Agreement but it does not include WWI;
d. WWI, there is cover for windscreen and headlight damage and tyre punctures but no reduction in Your DLF and no cover for wheel damage, tyre damage, such as spiking or slashing, or damage to side and rear windows.

4.6 If You or any driver whether authorised by Us or not breach the Rental Contract neither DLF nor Other Cover Products provide cover and You and any driver are each liable for:
a. damage;
b. storage, repossession and recovery fees;
c. assessing fees;
d. roadside assistance;
e. administrative and legal costs of recovery;
f. loss of Use.

4.7 You must always pay and there is no cover for:
a. the DLF if there is Damage, unless You have purchased SPOM;
b. the cost of rectifying tyre punctures, windscreen or headlight damage, unless You have purchased SPOM, POM or WWI;
c. Damage that occurs whilst a Commercial Vehicle is being driven in reverse;
d. Damage that is caused to a Vehicle with a convertible roof by overfilling the luggage compartment above the recommended level, and then activating the convertible roof mechanism;
e. Overhead Damage or any other Damage caused by:
i. contact between the Vehicle and objects overhanging or obstructing the path of the Vehicle; or
ii. objects being placed on the roof of the Vehicle; or
iii. You or any person standing or sitting on the roof of the Vehicle.
f. Damage caused deliberately or recklessly by You, any unauthorised driver or any passenger of the Vehicle;
g. Damage to the underbody of the Vehicle and any resulting Damage linked to that underbody Damage;
h. any water Damage caused by immersion of the Vehicle in water, including whilst the Vehicle is being transported;
i. Damage caused or contributed to by You or any driver where You or the driver leaves the scene of the Accident prior to the attendance of the police or reporting the Accident to the police;
j. the full cost of replacing or repairing any accessories supplied by Us including, but not limited to, child restraints and GPS units and lost keys;
k. Damage caused by use of the incorrect fuel type;
l. Damage if the Vehicle is taken into any area prohibited by the Rental Contract;
m. property that is stolen from the Vehicle, lost or damaged during the Rental Period or left in the Vehicle after the Vehicle is returned to the Rental Station;
n. loss or damage to Your property or the property of an entity related to You that arises from the use of the Vehicle.

4.8 Compulsory Insurance (Included in Rates):
Damage Liability Fee (DLF)
Liability is $3,850 for ECMR, CDAR, IDAR, IXAR, SDAR, FDAR, FWAR,PVAR and $5,500 for PFAR, IVAR, LDAR & FFAR/FFMR. The Damage Liability Fee (DLF) shown in the Rental Agreement must be paid if there is Damage.

Fair Wear & Tear (FWT)
Classified very minor damage that is deemed reasonable during the rental of a vehicle. Damage Charges will not apply: Includes chips up to 2mm radius(no dent). Scratches up to 10mm length and 1 mm width (no dent) or any scratches than can be polished out.

4.9. Optional Insurance:
Loss Damage Waiver Insurance (LDW)
This insurance costs $ 26 per day for cars, all wheel drive & minibuses, it will reduces liability to $ 390 for cars, minibues and all wheel drive.
For PFAR, FFAR, FFMR and LDAR, IVAR, this insurance costs $ 29 per day, and will reduces liability to $ 990 for FFMR LDAR and FFAR, IVAR.

Wheels, Windsreens & Iridescences (WWI)
This insurance cost $8.8 per day for cars, all wheel drive & minibuses, and $ 14.30 for LDAR,IVAR, WWI is Not available to purchase on FFAR/FFMR & PFAR.

Peace of Mind(POM)
This insurance costs $31 for cars, all wheel drive & minibuses, $39 for LDAR and IVAR, POM is NOT available to purchase on FFAR/FFMR & PFAR, and it will reduces liability to $390 for cars, all wheel drive and minibuses, $990 for IVAR and LDAR. Special OFFER Package including LDW & WWI Combined.

Snow Cover
- Snow coverage is compulsory for vehicles travelling above the snow line.
- The cost is at $11.00 inc GST (AUD) per day for all vehicle classes excluding FFAR/PFAR.
- For an FFAR/PFAR vehicle class, the cost is at $35.00 inc GST (AUD) per day.
- Chains can be supplied & fitted by the client however chain damage is not covered. Roof racks can be supplied & fitted by the client however roof damage is not covered.

5. Your Responsibilities
5.1 In this section, We set out the responsibilities You have to Us when You hire one of Our vehicles. You should be aware that a failure to fulfill any of these responsibilities is a breach of the Rental Contract with the consequences that are set out in clause 4.6.

5.2 The Vehicle must only be driven by You.

5.3 You must:
a. be no less than 21 years of age and additional charges will apply for specific vehicles and drivers under the age of 25;
b. hold a full, current, unrestricted driving licence for the Rental Period valid for the Vehicle and which is written in English or an international licence translated into English;
c. allow Us to inspect Your licence at any time during the Rental Period;
d. fully inspect the Vehicle at the Start of Rental to ensure the condition of the Vehicle and any pre-existing damage is accurately noted and shown in the Rental Agreement. If there is any discrepancy, You must notify Us prior to leaving the Rental Station;
e. tell Us if You will be using the Vehicle to drive interstate.

5.4 During the Rental Period You must:
a. take all reasonable care of the Vehicle:
i. to prevent Damage;
ii. to ensure that the Vehicle is not overloaded by the number of persons or by the weight of goods carried;
iii. by using any security device fitted to or supplied with the Vehicle; and
iv. by protecting the Vehicle against inclement weather;
b. keep the Vehicle locked and the keys under Your personal control at all times. You must be able to produce those keys in the event of a theft;
c. maintain all of the Vehicle’s engine and brake oils, engine coolant levels and tyre pressures;
d. use the correct fuel type;
e. comply with all seat belt laws and fines may be imposed on any driver or passenger who does not have a seat belt properly adjusted and fastened;
f. comply with all child restraint laws and ensure that for all children under the age of seven years the restraint has been fitted correctly according to the age of the child and that the restraint is properly adjusted and fastened;
g. return the Vehicle and any accessories supplied by Us including, but not limited to, child restraints and GPS units in the same condition as at the Start of Rental;
h. adhere to any mileage instructions displayed in the Vehicle or set by the Rental Station;
i. immediately upon request provide Us and any government or competent authority Your full, accurate and up-to-date information relating to the use of the Vehicle during the Rental Period.

5.5 You must never:
a. use the Vehicle when it is damaged or unsafe;
b. drive the Vehicle whilst under the influence of alcohol or drugs or have a blood alcohol content or level of drugs present in blood, urine or oral fluid that exceeds the limit in the state or territory where the Vehicle is driven;
c. fail or refuse to undergo any breath, blood, oral fluid or urine test or drug impairment assessment in the state or territory in which the Vehicle is driven;
d. drive the Vehicle whilst Your driving licence is subject to any restriction or condition;
e. commit any willful act or act of driver abuse that causes Damage;
f. drive the Vehicle dangerously or recklessly;
g. use a mobile phone or a GPS unit whilst the Vehicle is in motion or stationary but not parked unless the body of the phone or GPS unit is affixed to the Vehicle and the phone or GPS unit is not being held or touched at any time whilst being used.
h. leave the keys to the Vehicle in it or with it whilst it is unattended or unoccupied by You or any passenger;
i. leave the Vehicle unattended following an Accident and before the arrival of a tow or salvage operator;
j. modify the Vehicle in any way and no roof racks or towbars are permitted unless fitted by Us;
k. use the Vehicle for carriage of passengers or property for hire, fare or reward unless the Vehicle is a Commercial Vehicle and You have Our prior written authority;
l. use the Vehicle for off-roading, reliability trials, contest, speed testing, driving instruction, to propel or tow another vehicle, in violation of any legislation, order or regulation affecting the use, loading or condition of the Vehicle, or for any illegal purpose;
m. use the Vehicle for transporting any animals, unless specifically approved by Us. Additional cleaning charges may apply and will be shown in the Rental Agreement;
n. sell, rent or dispose of the Vehicle.

5.6 You and any passengers must not smoke in the Vehicle. It is an offence in some Australian states to smoke in a vehicle where there are passengers of less than 18 years of age. Additional cleaning charges will apply if there is a breach of this condition.

5.7 Parts of Australia are not suitable for access by rental vehicles. To prevent damage to the Vehicle and for Your own personal safety We strictly apply conditions that restrict Your use of the Vehicle.

5.8 Unless We have given Our prior written consent, You must never take the Vehicle:
a. on any Unsealed Road unless Unsealed Road Cover - 4WD or ALWD has been purchased;
b. above the Snow Line unless Snow Cover has been purchased.

5.9 Even if Unsealed Road Cover - 4WD or ALWD has been purchased You must never take the Vehicle:
a. Off Road;
b. onto any island that is off mainland Australia or Tasmania;
c. on flood prone roads or any road where the police or any government or statutory authority has issued a flood warning, caution or which has been closed;
d. onto any road where We have notified You that the use of the Vehicle is prohibited;
e. in Queensland:
i. north of Chillagoe or Georgetown;
ii. north of Cooktown or Laura;
iii. on the Burke Development Road;
iv. north of Maggieville;
v. on Unsealed roads north and west of Mt Isa;
vi. on the Bloomfield track;
vii. on the Savannah Way;
f. in Western Australia:
i. on the Gibb River Road;
ii. on the Cape Leveque Road and to Windjana Gorge;
iii. on the Cardabia Ningaloo Road;
iv. on the Tanami Track;
g. in the Northern Territory:
i. on the road from Jim Jim Falls to Twin Falls;
ii. on the Larapinta and Namitjira Drives, commonly known as the “Mereenie Loop”;
iii. on the Tanami Track.

6. Our Responsibilities
6.1 When You make a reservation with Us We will provide a Vehicle that is in good working order for the Rental Period.

6.2 If the Vehicle breaks down during the Rental Period because of Our negligence or wilful default We will as soon as possible recover and repair the Vehicle. If the Vehicle cannot be repaired, We will use Our best endeavours to provide a replacement Vehicle of an equivalent size and standard to the previous Vehicle for the remainder of the Rental Period.

6.3 If it is not possible to conduct a Final Inspection of the Vehicle with You at the end of the Rental Period We will confirm the condition of the Vehicle with You within 4 working hours of the Final Inspection.

6.4 We are only responsible for any direct loss that You suffer as a result of Our breach of the Rental Contract. We are not responsible for missed flights, disrupted travel or holiday plans, loss of enjoyment or opportunity, indirect or consequential loss.

7. Breakdown, Accident & Repair
7.1 Inherent mechanical faults in the Vehicle receive free roadside assistance.

7.2 Fees and charges apply for all other faults or driver induced errors, including but not limited to: (a) Incorrect refuelling; (b) a flat battery; (c) lost keys; (d) keys locked in the Vehicle; (e) tyre changing.

7.3 We reserve the right not to replace the Vehicle if it is involved in a major Accident or there has been major Damage or You have breached the Rental Contract.

7.4 If:
a. a warning light appears; or
b. You see or become aware of low engine or brake oils, engine coolant levels or tyre pressures; or
c. the Vehicle develops any fault during the Rental Period,
You must inform Us immediately via the contact details in the Vehicle and in the Rental Agreement and not use the Vehicle unless We have authorised You to do so. If You fail to notify Us and continue to use the Vehicle You will be responsible for any Damage.

7.5 You must not let anyone work on the Vehicle or arrange or undertake any repairs to the Vehicle or towing or salvage of it unless We have given You Our prior authority. You must keep and produce to Us the original tax invoices and receipts for any repairs, towing or salvage and You will be reimbursed only if these expenses have been authorised by Us. Any entitlement to reimbursement is subject to there being no breach of the Rental Contract.

7.6 If You have an Accident, You must:
a. get the names and addresses of all persons involved, including witnesses;
b. make the Vehicle secure, inform the police and notify Us immediately;
c. supply Us with any information concerning the driver of the Vehicle and You must allow Us direct access to the driver of the Vehicle and You must fully co-operate in allowing Us to gain such access;
d. not make or give any offer, promise of payment, settlement, waiver, release, indemnity or admission of liability;
e. permit and assist Us to bring, defend, enforce or settle any legal proceedings against a third party, including attending at a lawyer’s office and/or court;
f. allow Us to claim in Your name under any applicable substitute vehicle insurance, and do everything that may be required to assist Us in making such a claim;
g. complete all documentation that We require and forward any third party correspondence or court documents to Us within 7 days of receipt.

8. End Of Rental Contract
8.1. At the end of the Rental Period, in addition to Your obligations under clauses 3.1 and 3.2, You must return the Vehicle to Us:
a. to the Rental Station;
b. in the same condition it was in at the Start of Rental;
c. at the date and time set in The Rental Agreement.

8.2 We allow a grace period of 29 minutes for the return of the Vehicle but if it is returned to Us more than 29 minutes after the time set for its return in the Rental Agreement You will be charged one full day’s extra rental. Standard daily rates will apply if the Vehicle is returned to Us more than 24 hours after the time set for its return in the Rental Agreement unless the Rental Contract has been extended by Us. You will also be liable for any repossession charges, Damage or any costs We incur.

8.3 If You return the Vehicle to a rental station other than that shown in the Rental Agreement, or when the Rental Station is closed, or any place other than a Europcar rental station:
a. a one way fee may apply;
b. You will be deemed to have returned the Vehicle only after the Final Inspection of it has been conducted by Us; and
c. the Rental Charges will continue and You will be responsible for Damage until that Final Inspection.

8.4 A bond that has been prepaid to Us is fully refundable to You provided that at the end of the Rental Period:
a. all amounts due to us under the Rental Contract have been paid;
b. the Vehicle has been returned to the Rental Station at the date and time set in the Rental Agreement;
c. there is no Damage;
d. the interior and exterior are clean;
e. the Vehicle has a full tank of fuel; and
f. the Rental Contract has not been breached.
We reserve the right to retain all or part of a bond if there is a breach of any of these conditions.

8.5. If We terminate the Rental Contract it will not affect Our right to receive any money We are owed under the Rental Contract. We can also claim reasonable costs from You if You do not meet any of the requirements of the Rental Contract.

9. Breach Of Rental Contract
9.1 We may terminate the Rental Contract and take immediate possession of the Vehicle if:
a. You breach the Rental Contract; or
b. a reckless breach of road or traffic legislation has taken place.

9.2 If the Rental Contract is terminated by Us You must pay for:
a. Damage;
b. storage and recovery fees;
c. assessing fees;
d. roadside assistance;
e. administrative and legal costs of recovery;
f. Loss of Use;
g. all reasonable costs and charges under the Rental Contract.

9.3 If We have terminated the Rental Contract You give Us permission to access and enter Your premises to repossess the Vehicle without using unreasonable force or causing damage.

10 Applicable Law
10.1 You have rights conferred by consumer legislation and neither this clause nor any other provision of the Rental Contract is intended to exclude, restrict or modify any implied terms or rights You may have under the Trade Practices Act or any other Federal, State or Territory legislation in Australia.

10.2 The laws of the state in which the Rental Station is situated and of the Commonwealth of Australia govern the Rental Contract.

11. Dispute Resolution
11.1 If You believe there has been an error in Your account or any complaint, Our staff at the Rental Station will help You in every way they can. If they are unable to assist You or if Your concerns are not resolved to Your satisfaction You may refer the matter to Our internal dispute resolution process.

11.2 Our internal disputes resolution officer will investigate the matter and try to reach a satisfactory outcome. You will be advised of Our final decision within 15 working days of the receipt of the referral.

12. Privacy Policy
12.1 We collect and use Your personal information to provide You with the best level of service possible.

12.2 We respect Your privacy so We take all reasonable steps to make sure that Your personal information is accurate and up to date and that it is protected from misuse, unauthorised access or wrongful disclosure.

12.3 Your personal information may be disclosed to related and non-related third parties with whom We have arrangements to protect Your privacy, such as one of Our program partners.

12.4 Your personal information may also be entered into Our centralised database which is managed by Europcar International and may be accessed by personnel, franchisees and licensees within that group, all of which are governed by group rules that protect Your privacy.

12.5 We recommend that You visit Our website www.europcar.com.au where Our privacy policy is comprehensively set out.

13. Payment Methods
An initial, non-refundable deposit will be secured at the time of booking confirmation. Accepted credit cards are Visa and Mastercard (transaction fee of 1.75% applies). Please note that this deposit amount is deducted from your total and the balance is payable directly to Europcar on arrival. Any changes that are made at the counter do not affect this initial deposit amount and it remains non-refundable.

Your deposit payable upon booking confirmation can be made using Visa or Mastercard. The remainder of your rental will be paid upon the collection of your vehicle and can be made using all major credit cards including: American Express, Visa & Mastercard, Diners Card.

Credit/Debit cards
All renters must have a valid credit card and must be presented on collection.
Europcar Australia accepts all recognised major credit cards including Visa, Mastercard, American Express and Diners Card. The credit card used for payment of the rental must be in the renter’s name. The renter’s signature must appear on the back of the card. Credit Card charges will incur a surcharge on all credit and debit cards of 1.65%. You should check with the Rental Station that Your proposed means of payment is acceptable to Us before signing the Rental Contract.

At the Start of Rental there must be sufficient funds available on Your credit card, Europcar charge card or Debit Card to cover the Rental Charges and any relevant bond applicable. When collecting the Vehicle the primary cardholder must be present.

If currency conversion is required for payment of amounts due to Us under the Rental Contract, We will apply the commercial exchange rate valid at the time We credit or debit Your credit card, Europcar charge card or Debit Card.

If a debit card is presented the client will be charged a deposit of $385, this deposit will be refunded once the vehicle is returned.
EFTPOS, Cash, Cheque and Debit Cards are now only accepted for passenger vehicles excluding PVAR and IVAR.
All other vehicles including commercial and prestige MUST pay by credit card.

Prestige Vehicle Security Bond – Prepaid & Pay Direct accounts
Customers wishing to rent an Audi will be asked for a security deposit equivalent to the Damage Liability Fee, for example: Standard DLF then $5500 will be preauthorised and Reduced DLF $990 will be pre authorised.
The exception to this will be the IXAR, PDAR & IXMD vehicles where the $385 deposit will be pre authorised.

All reservations for Audi rentals (excluding the IXAR - Audi A3) will require two credit cards to secure the rental. The first credit card will be charged the rental amount and the second credit card will be charged a security bond of $100. If there are no additional charges, this security bond will be refunded upon the vehicle’s return.

14. Vehicle

Change of vehicle
Should the vehicle booked be unavailable through unforeseen circumstances, Europcar reserve the right to substitute an alternative vehicle without prior notification and at no extra cost. This shall not constitute a breach of contract and does not entitle the hirer to a refund.
In the event that Europcar is unable to provide a vehicle, no compensation will be provided

Vehicle category
Vehicles cannot be requested by make or model, only by vehicle category

Kilometre Restrictions
Australia
• Rate of the day Product – conditions will apply and will be advised upon making your reservation.
• Additional kms are charged at 27.5 cents per km.

One Way Rentals
Prestige Vehicles- are not available for one way rentals. Special requests will be considered for long term rental only.

Refunds
There will be NO REFUNDS on unused days once rental has commenced.

Fuel
The Vehicle is supplied with a full tank of fuel. If You do not take the “prepaid fuel” option and return the Vehicle without a full tank of fuel a refuelling charge will apply. You must also pay for any fuel used for the delivery and collection service.

Maps
Street directories can be provided at an additional charge. A replacement fee of $50AUD will be charged if the street directory is not returned.

15. Equipments

GPS Units
Europcar Australia can provide portable GPS Units which can be fitted to any passenger or commercial vehicle. Available on request only and must be pre-booked in all major cities at airports and downtown locations.

GPS units are $10.95 incl GST per day and may be taken one way with a $25 drop off fee.
The damage liability fee of the GPS unit is $550 (includes GST, excludes additional fees & surcharges).

Baby Seats
Europcar Australia can provide reversible baby seats for all passenger vehicles. They are suitable for children aged 0 to 4 years. Baby & Booster seats are required to be pre-booked to ensure supply upon arrival and are on a request basis ONLY. Cost is $7.70 incl GST per day or a maximum charge of $77.00 inc GST capped at 10 days.
Europcar Australia does not supply baby capsules however can supply booster seats (foam) if required in Australia.

New rules for using child restraints and booster seats
From 9 November 2009 there will be some changes to Victoria’s road safety rules. These changes include new rules for the use of child restraints and booster seats in vehicles and will help parents and carers ensure their children are in the safest child restraint or booster seat for their age.

The new rules for using child restraints and booster seats
Starting 9 November 2009, children under seven years of age must wear a child restraint or booster seat when traveling in a car for improved safety.

The type of restraint will depend on the age of the child as follows:
• Children aged under six months must wear an approved, properly fastened and adjusted, rear facing child restraint
• Children aged between six months and under four years must wear an approved, properly fastened and adjusted, rear facing child restraint OR a forward facing child restraint with an in-built harness
• Children aged between four years and under seven must wear an approved, properly fastened and adjusted, forward facing child restraint with an in-built harness OR an approved booster seat which is properly positioned and fastened.

There are also new laws for where children can sit in vehicles.
• If a car has two or more rows of seats, then children under four years must not travel in the front seat
• If all seats, other than the front seats, are being used by children under seven years, children aged between four and six years (inclusive) may travel in the front seat, provided they use an approved restraint or booster seat.

16. Driving Restrictions
Australia
3.1 Subject to clause 3.3 you must only use the vehicle on a surface which is sealed.
3.2 Subject to clause 3.3 you may use the Vehicle on a gazetted road, if it is a 4WD (IFDR/FFAR/PFAR).
3.3 The following roads are only allowed to be driven in an FFAR and PFAR. This is subject to road conditions at time of rental.
a) The Cadabia – Ningaloo Road
b) Jim Jim Falls Road
It is compulsory to hire a second spare wheel for travel on these roads:
Second spare wheel is $15 per day incl GST. Capped at 14 days $210
c) on the Gibb River Road.
d) on the Cape Leveque Road and to Windjana Gorge
e) on the Larapinta and Namitjira Drives, commonly known as the “Mereenie Loop”
f) Bungle Bungles

iii) no vehicles are permitted on Fraser Island.

Travel on Ferry Services and Trains in Australia
• Travel on Ferry Services in Australia is permitted, for example, to Kangaroo Island but will not be covered by insurance whilst on the ferry.
• Travel on Trains is permitted

Vehicle Registration Recovery Fee (VRRF)
VRRF is a mandatory fee charged per day to partially recover the Vehicle Registration costs. VRRF is charged at $6.05 (AUD) per day.

Administration Fee
An Administration fee of 3.5% will be charged on all rental charges. All additional extras paid direct to Europcar on arrival such as One Way Fees, Baby Seat, Fuel, GPS Unit & Additional Liability coverage’s etc will incur the admin fee.

Drivers Licenses
• Driver’s license must be valid for the period of rental.
• Drivers licence can be from any country. If the licence is not in English, an international drivers licences MUST be presented along with drivers licence from country of origin.
• Probationary or restricted licences are not acceptable nor are photocopies.
• For identification purposes, we also require clients to provide their credit card details.
• Photocopies of credit cards are not acceptable as ID.

Age Surcharge and Restrictions
A customer must be a minimum of 21 years of age to be eligible to rent a car from Europcar Australia and must have a full licence (not probationary or restricted). However, there are restrictions for renters under the age of 25.

• 21-24yr olds must pay Age Surcharge of $28.50 (AUD) per day in Australia.
• Drivers Aged 21-22 cannot reduce their Damage Liability, however they can purchase WWI
• Drivers Aged 21 – 24 can only rent ECMR, CDAR, IDAR, SDAR, IFDR
• A minimum age of 25 yrs is required for the following vehicles FDAR, FWAR, PVAR, IVAR, 4WD (FFAR/PFAR) and prestige vehicles.

Additional Drivers
When collecting the vehicle each driver must be listed on the Rental Agreement and they must present their drivers licence at time of collection. An additional driver is charged at $5.50 (AUD) per day, per driver and is capped at 5 days ($27.50 per additional driver).

Greenfleet Program
Transport is Australia’s fastest growing source of green house gas emissions.
Europcar is striving to become a greener car company by promoting environment awareness in the car rental industry and amongst consumers.
For every rental vehicle added to our fleet we will offset the carbon emissions by planting 17 trees through our partner Greenfleet.
We ask our customers to make a $3 donation to Greenfleet every time they rent with us.
(This amount is deductible)

Maintenance and Safety
Europcar Australia constantly strives to provide vehicles of the highest quality in order to keep our customers totally satisfied. To help us to do so, it is important you look after your vehicle properly from the moment you pick it up to the time you drop it off.
If you detect any damage to the vehicle you are hiring and it has not been recorded on the Rental Agreement, pleas notify Europcar staff before you depart with the vehicle to avoid disputes upon return.

Premium Location Fee (PLS)
All airport pickups are subject to a Premium Location Surcharge and the percentage fee varies by airport.
PLS is charged on all items with the exception of Greenfleet, GST and Tolls in Melbourne.

Remote Location Delivery/Collection Fee
Exmouth incurs a delivery fee to Learmonth airport of $33 incl GST and collection fee of $33 incl GST. Total $66.

Tolls

24 Hour Roadside Assistance
• Europcar provide a 24 hour emergency road side assistance service.
• Roadside assistance is free for all mechanical damage defects not resulting from Renter misuse of the vehicle.
• We charge for all non-mechanical defects such as lost keys, keys locked in the vehicle, flat battery due to lights being left on etc. Costs charged can be obtained by contacting Customer Service.

Please Note – In the second quarter of 2010 we will be changing systems to Greenway; therefore some of our terminology will change.

In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. Liability
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Europcar Australia Insurance

Covers And Waivers
1 The Damage Liability Fee (DLF) shown in the Rental Agreement must be paid if there is Damage.

2 If Other Cover Products are purchased to reduce Your liability We will provide cover for Damage but unless You have purchased SPOM You must pay the reduced DLF shown in the Rental Agreement.

3 The DLF shown in the Rental Agreement is payable for each separate event and whether You are at fault or not. It is payable to Us within 7 days of Our demand being made to You.

4 Neither DLF nor Other Cover Products provide cover for personal belongings and each level of cover is subject to You not being in breach of the Rental Contract.

5 If the Vehicle is involved in an Accident and You have purchased:
a. SPOM, which is Our premium cover, Your DLF liability is nil;
b. POM, Your DLF is reduced to the amount shown in the Rental Agreement and it includes WWI;
c. LDW, Your DLF is reduced to the amount shown in the Rental Agreement but it does not include WWI;
d. WWI, there is cover for windscreen and headlight damage and tyre punctures but no reduction in Your DLF and no cover for wheel damage, tyre damage, such as spiking or slashing, or damage to side and rear windows.

6 If You or any driver whether authorised by Us or not breach the Rental Contract neither DLF nor Other Cover Products provide cover and You and any driver are each liable for:
a. damage;
b. storage, repossession and recovery fees;
c. assessing fees;
d. roadside assistance;
e. administrative and legal costs of recovery;
f. loss of Use.

7 You must always pay and there is no cover for:
a. the DLF if there is Damage, unless You have purchased SPOM;
b. the cost of rectifying tyre punctures, windscreen or headlight damage, unless You have purchased SPOM, POM or WWI;
c. Damage that occurs whilst a Commercial Vehicle is being driven in reverse;
d. Damage that is caused to a Vehicle with a convertible roof by overfilling the luggage compartment above the recommended level, and then activating the convertible roof mechanism;
e. Overhead Damage or any other Damage caused by:
i. contact between the Vehicle and objects overhanging or obstructing the path of the Vehicle; or
ii. objects being placed on the roof of the Vehicle; or
iii. You or any person standing or sitting on the roof of the Vehicle.
f. Damage caused deliberately or recklessly by You, any unauthorised driver or any passenger of the Vehicle;
g. Damage to the underbody of the Vehicle and any resulting Damage linked to that underbody Damage;
h. any water Damage caused by immersion of the Vehicle in water, including whilst the Vehicle is being transported;
i. Damage caused or contributed to by You or any driver where You or the driver leaves the scene of the Accident prior to the attendance of the police or reporting the Accident to the police;
j. the full cost of replacing or repairing any accessories supplied by Us including, but not limited to, child restraints and GPS units and lost keys;
k. Damage caused by use of the incorrect fuel type;
l. Damage if the Vehicle is taken into any area prohibited by the Rental Contract;
m. property that is stolen from the Vehicle, lost or damaged during the Rental Period or left in the Vehicle after the Vehicle is returned to the Rental Station;
n. loss or damage to Your property or the property of an entity related to You that arises from the use of the Vehicle.

8 Compulsory Insurance (Included in Rates):
Damage Liability Fee (DLF)
Liability is $3,850 for ECMR, CDAR, IDAR, IXAR, SDAR, FDAR, FWAR,PVAR and $5,500 for PFAR, IVAR, LDAR & FFAR/FFMR. The Damage Liability Fee (DLF) shown in the Rental Agreement must be paid if there is Damage.

Fair Wear & Tear (FWT)
Classified very minor damage that is deemed reasonable during the rental of a vehicle. Damage Charges will not apply: Includes chips up to 2mm radius(no dent). Scratches up to 10mm length and 1 mm width (no dent) or any scratches than can be polished out.

9. Optional Insurance:
Loss Damage Waiver Insurance (LDW)
This insurance costs $ 26 per day for cars, all wheel drive & minibuses, it will reduces liability to $ 390 for cars, minibues and all wheel drive.
For PFAR, FFAR, FFMR and LDAR, IVAR, this insurance costs $ 29 per day, and will reduces liability to $ 990 for FFMR LDAR and FFAR, IVAR.

Wheels, Windsreens & Iridescences (WWI)
This insurance cost $8.8 per day for cars, all wheel drive & minibuses, and $ 14.30 for LDAR,IVAR, WWI is Not available to purchase on FFAR/FFMR & PFAR.

Peace of Mind(POM)
This insurance costs $31 for cars, all wheel drive & minibuses, $39 for LDAR and IVAR, POM is NOT available to purchase on FFAR/FFMR & PFAR, and it will reduces liability to $390 for cars, all wheel drive and minibuses, $990 for IVAR and LDAR. Special OFFER Package including LDW & WWI Combined.

Snow Cover
- Snow coverage is compulsory for vehicles travelling above the snow line.
- The cost is at $11.00 inc GST (AUD) per day for all vehicle classes excluding FFAR/PFAR.
- For an FFAR/PFAR vehicle class, the cost is at $35.00 inc GST (AUD) per day.
- Chains can be supplied & fitted by the client however chain damage is not covered. Roof racks can be supplied & fitted by the client however roof damage is not covered.
